Have any doubts regarding the Affidavit of Support Requirements and Criteria? Then, everything is explained to make your sponsoring process easier than ever.

An Affidavit of Support must be submitted to the United States Citizenship and Immigration Services (USCIS), which guarantees that the intended immigrant has sufficient funds.

Moreover, it assures the government that the immigrant won’t be a financial burden on society by relying on public assistance programs like Medicaid, Food Stamps, Supplemental Security Income (SSI), and Temporary Help to Struggling Families.

Suppose it is discovered that a sponsored beneficiary relies on public assistance from a Federal or State agency. In that case, the applicant will be obligated to pay the government through a legal process.

The phrase “there is an exception to every basic guideline” is familiar to you. Because some categories of potential immigrants do not need sponsors, there are specific situations when you will not need to demonstrate the income level in your home to qualify as a sponsor.

Affidavit of Support for the following categories is not required:

  • A potential immigrant who has accrued 40 quarters of employment, which satisfies the Social Security Administration’s basic wage requirement, is not required to have a financial sponsor. The potential immigrant should not count any working quarters during which they received state assistance from a Federal or State agency as qualifying quarters.

You can get advice from the Social Security Administration (SSA) on calculating the value of your labour and how much of it can be awarded to you. You can also get instructions from the SSA on presenting proof of your qualifying quarters of employment.

Additionally, the prospective immigrant may be entitled to reimbursement for any eligible quarters earned by a parent when the prospective immigrant was under 18 and for any work performed during a marriage.

  • Widows and widowers who self-petition and have a certified Form I-360, Application for Amerasian, Widow or Widower and Special Immigrants, are also exempt from this requirement.
  • Additionally exempt are abusive spouses or kids who have self-petitioned and have an authorized Form I-360.
  • According to the Child Citizenship Act of 2000, a prospective immigrant is exempt if they plan to become citizens of the United States (CCA). It is unnecessary to file a Declaration of Support on behalf of a child who is adopted by or born to a genetically U.S. citizen parent but did not obtain citizenship at birth to file a petition.

The child who will become a U.S. citizen upon entry into the United States does not require an affidavit of support because the obligations of one expire when an intended immigrant has become a U.S. citizen.

The following conditions must be satisfied for a child to be excluded from the Affidavit of Support demands:

  • The child must have at least one U.S. citizen parent.
  • The child is under 18 when their status is changed or admitted.
  • The child must reside in the U.S. and be under the supervision of a parent who is a U.S. citizen.
  • Before the child was admitted to the U.S., the adoption process had to be legally concluded. Before and during the adoption procedure, the adopted alien child must have been closely observed by the adopted families or an adoptive single U.S. citizen serving as a parent.

You must submit Form I-864W, Intending Immigrant’s Affidavit of the Support Waiver form, instead of filing a Form I-864 for an affidavit of support.
